There Are 3 Types of Land Search :

1) Private Land Search

2) Official Land Search

3) CTC Title


What is Private Land Serach (Catatan Carian Persendirian)?

A black & white printout issued by respective land office with the following information of the property/land:-

  • Full title details
  • Status of the Land/Property (Freehold or Leasehold)
  • Tenure of the Land/Property (if it is Leasehold)
  • Current registered landowners
  • Restrictions in interest
  • Current encumbrance(s)/endorsement(s)
  • Previous encumbrance(s)/endorsement(s) which is invalid
  • Unregistered Presentation
  • Previous title details
  • Revised Quit Rent charges

 

What is Official Land Serach (Catatan Carian Rasmi)?

A black & white printout with Land Registrar stamp and officer’s signature on the last page which is use as part of supporting documents for government agency submission containing the following information of the property/land:-    

  • Full title details
  • Status of the Land/Property (Freehold or Leasehold) 
  • Tenure of the Land/Property (if it is Leasehold)
  • Current registered landowners 
  • Restrictions in interest
  • Current encumbrance(s)/endorsement(s)  
  • Previous encumbrance(s)/endorsement(s) which is invalid
  • Unregistered Presentation 
  • Previous title details 
  • Revised Quit Rent charges

 

What is CTC Title (Salinah diakui sah Hakmilik)?

A copy of the original title and pelan tanah which duly certified true copy by the Land Registrar. Not to be use in place of Original Title for Presentation.

 


 


What Details Does Land Search Result Contain?

          


 

Land Search contains important information regarding a property or land that can be obtained through respective land registrar offices throughout Malaysia. Information such as the registered owner(s), whether the property or land is with encumbrance(s) or other impediments (s) is helpful during decision-making in acquiring the property or land especially during Proclamation of Sale.

 

Important information that is stated on a land search such as:-

1. Land status, whether the property is freehold or leasehold.

2. Whether the property is Malay reserve land.

3. Any restrictions in interest.

4. The land size.

5. The currently registered landowner.

 6. Land encumbrances.

 

3 types of Land Search that can be conducted:-

 

Master Land Search  Individual Land Search Strata land Search 

1. Contains information on the undivided land that is still under the Developer or proprietor's name.

1. Can be conducted once the land is subdivided.

1. Can be conducted once the land is subdivided.

2. Not advisable if you are intending to look for information about a particular property within the housing project.

2. Is for the specific landed property. 2. Is for the high rises property. 
 

3. Eg: Terrance or Semi-D house, Bungalow, or individual land plot. 

3. Eg: Flat, Apartment, Condominium, Serviced apartment, Townhouse & ,etc. 

 

Therefore, here are some features to look for to distinguish:-

 

  Master Land Search   Individual Land Search Strata land Search 

Land Size is usually huge. 

Land Size is usually within usual square meters of landed property.  

Contains several forward slashes '/' in the title number. 

 

Even though the land search may contain some if not all important information pertaining to a property or land, Land Search does not yield the following:-

  1. Registered Power of Attorney
  2. Whether the property or land is a Bumi Reserved Lot (do not be confused with Malay Reserved Land status)

 

To enable you to conduct a successful land search, you are required to have the full title detail. Unfortunately, the property’s postal address cannot be used to conduct a land search nor a reverse search by using someone’s name and NRIC No. to search for any property registered to the individual.

 

Where to obtain full title details:-

  • Individual or Strata title deed
  • Quit Rent bill (applicable to landed property or Selangor strata property)
  • Sale & Purchase Agreement (the title detail may be invalid if the property is acquired many years before, therefore it is best to check with the Developer or building management)

2) Taraf Pengangan

Land Status

Selama lama = Freehold 

Pajalan = Leasehold 

If it is leasehold, then you will know the lease expiry date at 'Tarikh Luput Pajakan'.

3) Kawasan Rizab

Malay Reserved Land 

If the land or property is Malay reserved Land, then it can only be transferred to Malay and need to apply for approval from the states

4) Sekatan Kepentingan

Restriction in Interest 

Restrictions in Interest, mostly applicable to Leasehold land as any change of name need to get a State Authority Consent approval letter.

5) Pemilikan dan Alamst

Ownership and Address  

The registered landowner(s) details are stated here. Do take note that some property may have registered many years ago thus the owner's NRIC number may still be the old NRIC no, or non at all. 

6) Tanggugan dan endorsan-endorsan lain. 

Encumbrances

All current and in effect encumbrances are stated here.

2(a)  Taraf   Pegangan  Land Status  

Selama-lamanya = Freehold

Pajakan = Leasehold.
2(b) Tarikh Luput Pajakan Lease Expiry Date If the property is Leasehold, the expiry date will be stated here. Land Search from other states may even state the Lease tenure such as 99 years
3  Kawasan   Rizab  Malay Reserved Land  If the land or property is Malay Reserved Land, then it can only be transferred to Malay and need to apply for approval from the states

9 Gadaian menjamin wang pokok  Charge  The information on when and which bank the registered owner(s) obtain the loan and Charge to the bank
10  Urusan-urusan dalam perserahan yang belum didaftarkan  Presentation that has not been registered Any Presentation submitted but have not be registered yet will be stated here
11 Urusan-urusan yang tidak berkuatkuasa Encumbrances not in effect  Past transfer, caveat, charge that are not in effect anymore
